Fenix AI Incorporated ("Fenix," "we," "us," or "our") operates an artificial intelligence platform accessible at getfenix.ai and related subdomains. Our services include AI-powered chat, image generation, document analysis, and educational tools for individuals, businesses, and educational institutions.
You must be at least 13 years of age to use Fenix AI. If you are under 18, you must have permission from a parent or legal guardian. Educational institution licenses may grant access to students under 13 only when the institution has entered into a valid Data Processing Agreement with Fenix AI Incorporated and complies with applicable laws including COPPA and FERPA.
By using our services, you represent that you meet these eligibility requirements and that all information you provide is accurate and complete.
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at support@getfenix.ai if you suspect unauthorized access to your account. Fenix AI is not liable for any loss or damage resulting from unauthorized account access caused by your failure to maintain credential security.
You may not share your account with others, create multiple accounts for the same person, or use automated means to create accounts.

Free accounts receive 50 messages per month. Free plan usage is subject to availability and may be modified or discontinued at any time with reasonable notice.
Pro subscribers receive unlimited messages, priority access, and all available features. Billing occurs monthly on the date of initial subscription.
Business subscribers receive unlimited messages, enhanced features, and priority support. Billing occurs monthly on the date of initial subscription.
School site licenses and university campus licenses are governed by separate institutional agreements and pricing. Contact us at support@getfenix.ai for institutional pricing.
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. We do not provide prorated refunds for partial months. If you believe you were charged in error, contact support@getfenix.ai within 30 days of the charge.
You retain ownership of content you submit to Fenix AI. By submitting content, you grant Fenix AI a limited license to process that content solely for the purpose of providing our services to you.
You are solely responsible for the content you generate using our platform. Fenix AI does not review all user-generated content and is not responsible for content that violates these terms or applicable law.
We do not claim ownership of your conversations, uploaded documents, or generated outputs.
The Fenix AI platform, including its design, code, trademarks, logos, and proprietary AI configurations, is owned by Fenix AI Incorporated and protected by applicable intellectual property laws. The FENIX AI trademark is a registered mark of Fenix AI Incorporated.
You may not copy, modify, distribute, or create derivative works of our platform without our express written permission.
Fenix AI uses large language models to generate responses. AI-generated content may be inaccurate, incomplete, or inappropriate for your specific situation. You should not rely on Fenix AI for medical, legal, financial, or other professional advice without independent verification from a qualified professional.
Fenix AI makes no warranty that AI-generated content is accurate, complete, or fit for any particular purpose.
Your use of Fenix AI is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the data practices described in our Privacy Policy.
We do not sell your personal data to third parties. We do not use your conversations to train AI models without your explicit consent.
Educational institutions using Fenix AI for Education must execute a Data Processing Agreement with Fenix AI Incorporated prior to student use. Fenix AI acts as a school official with legitimate educational interest under FERPA when operating under a valid institutional agreement.
Student education records processed through institutional licenses are handled in accordance with FERPA requirements and are not used for advertising, model training, or any purpose other than providing the contracted educational services.
To the maximum extent permitted by law, Fenix AI Incorporated shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to loss of data, loss of revenue, or loss of business opportunity.
Our total liability to you for any claim arising from these Terms or your use of our services shall not exceed the amount you paid to us in the twelve months preceding the claim.
Fenix AI services are provided "as is" and "as available" without any warranty of any kind, express or implied. We do not warrant that our services will be uninterrupted, error-free, or free of harmful components. We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.
You agree to indemnify and hold harmless Fenix AI Incorporated, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services, your violation of these Terms, or your violation of any third-party rights.
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on our platform at least 14 days before the changes take effect. Your continued use of our services after the effective date constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.
