• Cookies — session management and authentication only; we do not use advertising cookies

3. How We Use Your Information

We use your information only to provide and improve our services:

• To operate and deliver the Fenix AI platform
• To process your messages and generate AI responses
• To save your conversation history so you can access it later
• To manage your account and subscription
• To process payments through Stripe
• To send you service-related communications — account confirmations, billing notices, and important updates
• To detect and prevent fraud, abuse, and violations of our Terms of Service
• To improve our platform based on aggregated, anonymized usage patterns

We do not use your personal conversations for advertising, profiling, or AI model training without your explicit consent.

4. How We Do NOT Use Your Information

We will never:

• Sell your personal data to any third party
• Share your conversation content with advertisers
• Use your conversations to train AI models without your explicit written consent
• Display targeted advertising based on your conversation content
• Share your information with data brokers
• Use your data for any purpose not described in this Privacy Policy without notifying you first

5. Information Sharing

We share your information only in these limited circumstances:

Service providers:

We work with trusted third-party services that help us operate our platform. These providers only access your data to perform services on our behalf and are bound by confidentiality obligations:

• Anthropic — processes conversation content to generate AI responses. Anthropic's API usage policies apply to content processed through their models.
• Google Firebase — stores user accounts and conversation history
• Stripe — processes payments securely
• Replicate — processes image generation requests
• Vercel — hosts our platform infrastructure

Legal requirements:

We may disclose your information if required by law, court order, or government authority, or if we believe disclosure is necessary to protect the rights, safety, or property of Fenix AI, our users, or the public.

Business transfers:

If Fenix AI is acquired or merges with another company, your information may be transferred as part of that transaction. We will notify you before your information becomes subject to a different privacy policy.

6. Educational Privacy — FERPA Compliance

• Student conversation data is stored in a dedicated, institution-specific database partition
• Student data is never used for advertising, model training, or any commercial purpose
• Student data is never shared with third parties outside the scope of the institutional agreement
• Institutions retain the right to access, review, and request deletion of all student data
• Students and parents may request access to education records through their institution
• Data Processing Agreements are available for all institutional clients upon request
• We cooperate fully with institutions' FERPA compliance obligations

7. Data Retention

We retain your information for as long as your account is active or as needed to provide our services. Specifically:

• Conversation history is retained until you delete it or close your account
• Account information is retained for 90 days after account closure before permanent deletion
• Payment records are retained for 7 years as required by financial regulations
• Log data is retained for 90 days for security and debugging purposes

You can delete individual conversations at any time from within the platform. To request full account deletion, contact support@getfenix.ai.

8. Your Rights and Choices

You have the following rights regarding your personal information:

• Access — request a copy of the personal information we hold about you
• Correction — request correction of inaccurate information
• Deletion — request deletion of your account and associated data
• Portability — request your conversation history in a portable format
• Opt-out — opt out of non-essential communications at any time
• Privacy settings — control data sharing preferences in your account settings

9. Data Security

We take the security of your information seriously. We use industry-standard security measures including:

• HTTPS encryption for all data in transit
• Firebase Security Rules to enforce user-level data access controls
• Secure authentication through Firebase Authentication
• Payment processing through PCI-compliant Stripe infrastructure
• Regular security reviews and access controls

No system is completely secure. If you believe your account has been compromised, contact support@getfenix.ai immediately.

10. Children's Privacy

Fenix AI is not directed at children under 13. We do not knowingly collect personal information from children under 13 without verifiable parental consent. Educational institutions may permit student access under 13 only through a valid institutional agreement that includes appropriate FERPA and COPPA protections.

If you believe a child under 13 has provided us personal information without appropriate authorization, contact support@getfenix.ai and we will promptly delete that information.

11. Cookies

We use cookies only for essential platform operation — specifically for authentication and session management. We do not use advertising cookies, tracking pixels, or third-party analytics cookies that share your data with outside parties.

You can disable cookies in your browser settings, but this may prevent you from logging into your account.

12. Third-Party Links

Our platform may contain links to third-party websites. We are not responsible for the privacy practices of those sites. We encourage you to review the privacy policies of any third-party sites you visit.

13. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by email or by posting a notice on our platform at least 14 days before the changes take effect. Your continued use of our services after the effective date constitutes acceptance of the updated policy.
